There is no time in which the government has the right to suppress the opinions of the people, war or not. The 1st amendment is in place to protect the people. ESPIONAGE ACT OF 1917 FREEThe first amendment says "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof or abridging the freedom of speech, or of the press or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances." Regardless of the circumstances at the time, suspending the rights to free speech for any reason severely undercuts the American people's inalienable constitutional rights, and therefore, is not permissible. Suspending the rights of free speech for any reason comes in the way of democracy (especially when the issue is one that affects everyone so personally), and reverts our country into a state of government that the United States was created to escape.Įverybody deserves the right to speak their mind, and the right to have the government listen. Because of that, and because of the fact that many people had very reasonable reasons to believe that the United States should not have been involved in the war, those dissenters' rights to speak out against the draft should have been upheld. The United States government is a democracy that, in concept, welcomes the input of the American people. However, the right to free speech is an inalienable right and cannot be stripped from the American citizen. While we do see the reasoning in the Supreme Court's ruling against Shneck, we believe that the court's ruling was unconstitutional as it violated Shneck's First Amendment right to the freedom of free speech.Īt this period in history, we do understand the need to recognize special circumstances, as war requires extreme national resources.
